The National Bioengineered Food Disclosure Standard (NBFDS) issued by the US FDA is causing confusion among food manufacturer who are held responsible for meeting the regulations.  While the food manufacturers are responsible for compliance with the disclosure standard, detailed information is required from their suppliers.  The USDA’s bioengineered foods list describes the foods for which companies must keep records and the foods for which the bioengineered foods disclosure may be required.  There is confusion about highly refined foods sourced from bioengineering that may be exempt from the notification.  According to the regulation, there must detectable modified genetic material that was created via lab techniques and not traditional breeding.  There is also industry confusion around the verbiage required.  The mandatory compliance date is January 1, 2022.
